To the fullest extent permissible by applicable law, RWB Civics disclaims all warranties, express or implied including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and/or infringement. When using the Platform, information will be transmitted over a medium that is beyond the control of RWB Civics. RWB Civics cannot and does not guarantee that use of the Platform will be error-free or free of technology downtimes or unavailability. RWB Civics cannot and does not guarantee against viruses, worms, or other unauthorized users or hackers attempting to obtain access to the Platform or information transmitted to or from the Platform. RWB Civics is not responsible for data, messages or pages lost, not delivered or misdirected because of interruptions or performance issues with the internet. USERS HEREBY EXPRESSLY ASSUME THE SOLE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION, OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THE WEBSITE.

IN NO EVENT SHALL RWB Civics BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR MONETARY DAMAGES, INCLUDING FEES AND PENALTIES IN CONNECTION WITH YOUR USE OF MATERIALS POSTED ON THE WEBSITE OR CONNECTIVITY TO OR FROM THE WEBSITE TO ANY OTHER SITE.

RELEASE

You hereby agree to release RWB Civics, other members of the Red Wine & Blue family of affiliated organizations, and their respective officers, directors, employees, contractors, agents, successors and assigns from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with your use of the Platform.

INDEMNITY

You shall indemnify, defend and hold harmless RWB Civics, other members of the Red Wine & Blue family of affiliated organizations, and their respective officers, directors, employees, contractors, agents, successors and assigns from and against any and all losses, claims, damages, settlements, costs, and liabilities of any nature whatsoever (including reasonable attorneys’ fees) to which any of them may become subject arising out of, based upon, as a result of, or in any way connected with, your importing of any content to the Platform or an Event or Group Page, any third party claims of infringement or any breach by you of these terms. Any claim or dispute arising out of or relating to the Platform or your use or reliance on the Platform and this Agreement shall be governed by the laws of the State of Ohio without regard to its conflict of laws provisions. You agree to the exclusive venue and jurisdiction of the local, state or federal courts located in Cleveland, Ohio, for the resolution of any such claim or dispute.

CHILDREN

The Platform is directed at adults, and therefore this site is intended for use only by adults over the age of 18. If you are under the age of 18, please consult a parent or guardian for permission and help in using the Platform.

How RWB Civics Uses the Information that It Collects
RWB Civics uses Users’ personal information to better understand how Users use the Website so that RWB Civics can improve the Website and its offerings. RWB Civics also uses Users’ personal information for the purpose for which the Users provided the information, in other words, to provide requested information, to process a donation, or to otherwise fulfill a request. If you provide RWB Civics with your email address, RWB Civics will add you to its email list and may contact you with information that RWB Civics thinks will be of interest to you. If at any time you wish to stop receiving communications from RWB Civics, please follow the unsubscribe instructions at the bottom of any email RWB Civics sends you, or send RWB Civics an email at hello@redwine.blue and ask to be removed from RWB Civics’ distribution list. If you provide RWB Civics with your cell phone number, you consent to receive autodialed and/or prerecorded messages at that number on any subject from RWB Civics. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

How RWB Civics Protects User Information
RWB Civics adopts appropriate data collection, storage and processing practices and security measures to help protect against unauthorized access, alteration, disclosure or destruction of your personal information, but RWB Civics cannot guarantee that your information is 100% secure. In addition, please recognize that email is not a secure method of communication, so you should not include sensitive information in any email you send to us. Your credit card information is stored in a manner that is PCI compliant.

Note that User information will be subject to the laws of the United States of America regardless of the country from which the User’s data originates

Sharing Personal Information
RWB Civics uses third party service providers to help it operate its business and the Website or administer activities on RWB’s, such as collecting donations online. RWB Civics may share User information with these third parties for those limited purposes but RWB Civics requires that such third parties protect the confidentiality of your information and use it for no other purpose.

In addition, RWB Civics may share personally identifiable information about Users with other like-minded organizations, including Red Wine & Blue and its affiliate organizations. Moreover, RWB Civics will share personally identifiable information about Users when required to do so by law, or in the good faith belief that such action is necessary to comply with state and federal laws or to respond to a court order, subpoena, or search warrant.

RWB Civics may share generic aggregated demographic information not linked to any personally identifiable information regarding Users with third parties.

Third Party Websites
RWB Civics may provide links from the Website to other websites. RWB Civics does not control the content or links that appear on these third party websites and is not responsible for the practices employed by websites linked to or from the Website. These websites and services have their own privacy policies. Browsing and interaction on any other website, including websites that have a link to or from RWB Civics’ Website, is subject to that website’s own terms and policies. This Privacy Policy covers only information collected through the use of RWB Civics’ Website. In addition, RWB Civics does not currently respond to web browser “do not track” signals.

Compliance and Agreements

Compliance with Children’s Online Privacy Protection Act
Protecting the privacy of the young is especially important. For that reason, RWB Civics never collects information at the Website from those RWB Civics knows are under 13, and no part of the Website is structured to attract anyone under 13. If RWB Civics becomes aware of having information about anyone under 13, RWB Civics will promptly delete the information.

Your State Privacy Rights
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

California Privacy Rights:
If you reside in California and have provided your personally identifiable information to RWB Civics, you may request information once per calendar year about RWB Civics’ disclosures of certain categories of your personally identifiable information to third parties for their direct marketing purposes.   • Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may send such requests to RWB Civics at hello@redwine.blue. However, please know we do not currently sell data triggering that statute’s opt-out requirements.
